October deadline for CGT tax refund in Spain
If you happen to have sold a Spanish property between 1997 and 2006 then you were illegally charged 35% Capital Gains Tax by the Spanish government.
Then the Spanish government imposed a capital gains tax of 35% on property sales by Britons and other EU residents, compared to 15% for Spanish nationals. Blatantly seen as unfair it also contravened the European Community Treaty rules on discrimination.
The law has recently changed and refunds are being given. This process can take up to 3 months so little time is left if you want to make a claim. Up to date over 500 Britons are reported to have claimed an average of £14,980 each from the Spanish tax office.
The criteria is that any EU citizen who sold a property in Spain between January 1, 1997, and December 31, 2006, can claim back the excess charge, that’s 20%, however it is a condition that all claims must be settled by the end of October 2010.
You also must have paid the annual Non Resident Tax at the time, in other words to have complied with your Tax obligations to qualify for making a claim.
Mark Bodega who is the marketing director of a currency specialist helped expose the tax scam. He told the Financial Times: “We have been fighting for the last two years to help British people reclaim the CGT that they were illegally overcharged by the Spanish government.
It is estimated there are thousands of EU citizens who sold a property in Spain in this time period who still haven’t made a claim. Time is running out and it may already be too late, once the deadline passes you will never be able to reclaim this money.
